O O CITY of ORONO
.;aa
RESOLUTION OF TECITY COUNCIL
NO.
kESHOg
NOW, THEREFORE BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File#12-3548.
2. The City's Wetland Specialist has reviewed the plans and has made a number
of recommendations regarding buffers to mitigate the impacts of the proposed
pavilion/deck structure.
3. The walkways and platforms along the shoreline are an allowed use in the
wetland buffer per Code Section 78-1606(b)(3) but require a variance because
these wetlands are located along the shoreline.
4. The Planning Commission reviewed this application on March 19, 2012 and on
a vote of 6 - 0 found that with conditions the application will satisfy the
requirements for granting of the requested variances and conditional use
permit:
a. The Applicant will provide evidence of the appropriate MCWD approval
prior to issuance of City building permits for the project.
b. The Applicant will apply for and receive the appropriate building permits
prior to commencement of the pavilion project and prior to construction of
additional observation platforms.
c. The Applicant will provide an erosion control plan and final buffer
mitigation plan to be approved administratively prior to issuance of
building permits.
5. The City Council makes the following additional findings regarding this
application:
a. The requested variances and CUP are necessary for the provision of
educational resources vital to the Orono School District's Environmental
Learning Program, and play a key role in the school's academic programs
including science, art and environmental systems.
Page 2of5
