O O CITY of ORONO <br /> CA RESOLUTION OF THE CITY COUNCIL <br /> a <br /> NO. 634 <br /> ��kESH01 <br /> A RESOLUTION GRANTING VARIANCES TO <br /> MUNICIPAL CODE SECTIONS 78-1279 AND 78-1605,AND <br /> A CONDITIONAL USE PERMIT <br /> PURSUANT TO SECTIONS 78-418 & 78-916 <br /> FILE NO. 12-3548 <br /> WHEREAS, Orono Public School District ISD 278 (hereinafter "the Owner") <br /> is the owner of the properties located at 685 Old Crystal Bay Road North (hereinafter the <br /> "Property") within the City of Orono (hereinafter the "City") and legally described as <br /> Government Lot 1, Section 33, Township 118, Range 23 West of the 5t` Principal Meridian, <br /> Hennepin County, Minnesota; and <br /> WHEREAS, the Owner has made application to the City for variances to <br /> Orono City Code Sections 78-1279 and 78-1605 to construct an open-sided 924 square foot <br /> pavilion with a 330 square foot deck to be located approximately 85 feet from the OHW of <br /> Lake Classen where a 150 foot structure setback is normally required and 5 feet from the <br /> delineated wetland edge where a 70 foot wetland buffer and buffer setback would normally be <br /> required; and <br /> WHEREAS, the Owner has made application to the City for variances to <br /> Sections 78-1279 and 78-1605 to construct two 142 square foot observation platforms and <br /> after-the-fact approval for three recently constructed 142 square foot observation platforms <br /> located approximately 5 feet from the OHW of Lake Classen and the delineated wetland edge <br /> where a 150 foot structure setback is required from the OHW; and <br /> WHEREAS, the Owner has made application to the City for a conditional use <br /> permit pursuant to Orono City Code Section 78418 because School use is a conditional use in <br /> the RR-1B Zoning District and any changes to that use require CUP approval; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br /> Commission held a public hearing on March 19, 2012, at which time all persons desiring to be <br /> heard concerning this application were given the opportunity to speak thereon. <br /> Page 1 of 5 <br />
