DIVISION 0 <br /> ' CONDITIONS OF THE CONTRACT <br /> 00800-SUPPLEMENTARY <br /> CONDITIONS <br /> I Take possession of the site and of all materials, equipment, tools, construction <br /> equipment and machinery thereon owned by the Contractor; may finish the <br /> Work by whatever method the Owner may deem expedient. <br /> i .2 Accept assignment of subcontracts pursuant to paragraph 5.4. <br /> 14.2.3 In the second line between the words "Contractor" and "shall" insert the words <br /> "or Contractor's Surety". <br /> 14.2.4 Change the wording to read: If the Owner completes the Work and the unpaid <br /> balance of the Contract Sum exceeds the costs of finishing the Work, including <br /> the Owner's additional costs, attorneys' costs and compensation for the <br /> Construction Manager's and Architect's additional services, such excess shall be <br /> paid to the Contractor. If such costs for the Owner to complete the work <br /> exceeds such unpaid balance, the Contractor and/or his Surety shall pay the <br /> ' difference to the Owner. The amount to be paid to the Contractor or to the <br /> Owner, as the case may be, shall be certified by the Owner or Contractor and <br /> reviewed by the Construction Manager, and approved by the Architect, and this <br /> obligation for payment shall survive the termination of the Contract. <br /> 14.4 Add Paragraph: Termination by Owner for Convenience <br /> 14.4.1 Add Subparagraph: The Owner may, at any time, terminate the Contract for the <br /> Owner's convenience and without cause. <br /> 14.4.2 Add Subparagraph: Upon receipt of written notice from the Owner of such <br /> termination for the Owner's convenience,the Contractor shall: <br /> 1 Cease operations as directed by the Owner in the notice; <br /> .2 Take actions necessary, or that the Owner may direct, for the protection and <br /> preservation.of the Work; and. <br /> .3 Except for Work directed to be performed prior to the effective date of <br /> termination stated in the notice,terminate all existing Subcontracts and purchase <br /> orders and enter into no further Subcontracts and purchase orders. <br /> 14.4.3 Add Subparagraph: In case of such termination for the Owner's convenience, <br /> the Contractor shall be entitled to receive payment from the Owner on the same <br /> basis provided in Subparagraph 14.1.2. <br /> EXISTING ORONO MIDDLE SCHOOL-NEW MEDIA CENTER SECTION 00800-23 <br /> BID PACKAGE 1: GENERAL CONSTRUCTION,MECHANICAL&ELECTRICAL <br />
