3/15/2017 Orono,MN Code of Ordinances PC Exhibit B <br /> ' 17-3923 <br /> DIVISION 5. - EXCEPTION <br /> Sec. 82-200. - Exception. <br /> (a) The following land subdivisions are excepted from divisions 1 through 4 of this article. Upon request, <br /> the community development director shall, within ten days, certify that a proposed subdivision is <br /> excepted because: <br /> (1) All the resulting parcels, tracts, lots or interests will be 20 acres or larger in size and 500 feet in <br /> width for residential uses and five acres or larger in size for commercial and industrial uses, or <br /> (2) Will create cemetery lots, or <br /> (3) Is court ordered, or <br /> (4) Is an adjustment of a lot line by the relocation of a common boundary as long as each of the two <br /> resulting lots meets the requirements of chapter 78 and no new non-conformities are created. <br /> a. Adjustment of a lot line by the relocation of a common boundary when one or both resulting <br /> lots do not meet the requirements, or other non-conformities are created may be certified <br /> following approval of a variance. <br /> (b) Procedure for exempted subdivisions. The owners of such lots to be certified shall file with the zoning <br /> administrator a certificate of survey of the lots to be divided, and pay the required fee. Such certificate <br /> of survey shall show the dimensions of the lots, as measured upon the recorded plan, the area of the <br /> lots, all corner elevations, all existing structures, including dimensions to existing and proposed <br /> property lines, all visible encroachments, all easements of record, and their proposed division. A written <br /> description of the separately described tracts which will result from the proposed division shall be <br /> included on the survey. If the proposed certification complies with all of the requirements of this <br /> section, it will be approved by the community development director and forwarded to the county for <br /> filing. <br /> (Ord.
