Maintenance and utility of the private road, and adherence to the <br /> neighborhood requirements, are responsibilities of the individual property owners and critical to <br /> continued and unimpeded access to, use and enjoyment of the private common areas by all <br /> residents. The 10' setback requirement is in place, in part,to (i)ensure the ability of residents to <br /> navigate the private roadway by allowing sufficient room for pulling over and passing, (ii) <br /> eliminate hazards and liabilities for residents and service providers who must access the road to <br /> perform a variety of tasks in including,among others, snow and brush removal, (iii)preserve <br /> opportunities for future improvements to the road, and (iv)maintain the aesthetics of the <br /> neighborhood as a natural, open view environment. <br /> The pillars in question interfere with the rights of the neighborhood residents and create a private <br /> nuisance in the following particulars: <br /> • The proximity of the pillars to the roadway creates a navigation hazard to passing cars by <br /> limiting the space available for passing in the event of a problem situation <br /> • The proximity of the pillars to the roadway also impedes the removal of snow and other <br /> debris from the road by limiting the space in which such removals may be accomplished, <br /> creating the potential for unsafe build up along the road and liability concerns on the part <br /> of service providers who are operating near the pillars <br />
