December 2, 2008
Paula Johnson
3818 North Shore Drive
Wayzata, MN 55391
Mazvin and Nancy Blair
5501 Village Drive, #205
Edina, MN 55439
Deaz Ms. Johnson and Mr. and Ms. Blair:
Please be advised that this law firm represents the City of Orono. I am writing
this letter in the hopes that I will be able to clarify the City's position regarding the
proposed work within the City's riht-of-way(Oak Place)that provides each of your
homes access to North Shore Drive. The City has received a proposed plan prepared
by Gronberg& Associates, Inc., dated November 5, 2008. It is my understanding that
this plan was prepared for Ms. 7ohnson. The City has reviewed the plan and the City
Engineer has provided comments. Provided that the plan dated November 5, 2008, as
well as the Engineer's comments are followed, the City has approved the proposed
plan. The current design, as approved by the City, is necessary to satisfy Hennepin
County, the City Code and the Fire Marshal.
There have been questions regarding who is responsible for the installation,
payment, and ultimate maintenance of the access being placed within the City's right-
of-way. The City will not be contributing any money towazd the construction that is
being proposed within the Oak Place right-of-way. Furthermore, the City will not
maintain or plow this area. It is up to each of you to decide how the eenses for this
project will be split between the two of you.
If you have any questions regarding this correspondence please feel free to
contact me at(651)2346217.
Very truly yours,
CAMPBELL KNUTSON
Professional Association
By:
Soren M.
