�°� <br /> 0 0 <br /> CITY of ORONO <br /> � � <br /> ti <br /> RESOLUTION OF THE CITY COUNCI� <br /> ��l ��'~ <br /> `�xEsHo�' � No. 5 7 � <br /> A RESOLUTION GRANTING VARIANCES <br /> TO MUNICIPAL ZONING CODE <br /> SECTION 78-1279(6), 78-1288 & 78-1403 <br /> FILE NO. 07-3329 <br /> WHEREAS, David Berg (hereinafter "the Applicant") on behalf of the property <br /> owner, Warren E. Berg Trust (hereinafter the "Owner"), of the property located at 3669 North <br /> Shore Drive within the City of Orono (hereinafter the "City") and legally described as follows: <br /> Lot 3, Crystal Beach and Adjacent Abandoned County Road, Hennepin County, <br /> Minnesota(hereinafter the"property"); and <br /> WHEREAS, the Applicant has made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-350 to allow a second-story addition to <br /> encroach 2.5' into the side yard where a 10' side yard setback is required and a 4.7' setback <br /> currently exists for the first story; and <br /> WHEREAS, the Applicant has made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-1279(1) to allow a second story addition <br /> to be constructed with a 51.5' setback from the lake where 75' is required; and 78-1279(6) to <br /> allow a second-story addition to encroach up to 17' into the average lakeshore setback where no <br /> encroachment is permitted and the first-story currently encroaches up to 17' into the average <br /> lakeshore setback; and <br /> VVHEI�EAS, the Applicant has made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-1288 to allow hardcover within the 0-7�' <br /> zone in the amount of 1,U46 s.f. (29.1%) where 0% is normally allowed and 1,129 s.f. (31.4°i�) <br /> currently exists and hardcover within the 75'-250' zone in the amount of 1,794 s.f. (76.7%) <br /> where 25% is normally allowed and 1,798 s.f. (76.9%) currently exists in conjunction with the <br /> second-story addition; and <br /> �'HERE 4S, the Applicant has made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-1403 to allow a structural covera�e level <br /> in the amount of 2,042 s.f. where 1,500 s.f. is permitted and 1,935 s.f. currently exists in <br /> conjunction with the construction of the second-story. <br /> Page 1 of 5 <br />
