Page 2
May 18, 2007
Mr. Mike Gaffron
3. Widening the road on Lots 11 and 12 will impact how close that road is to the
existing structures on Lots 11 and 12 in an area where the road is already very close to the
buildings. Without an additional easement, the City would be left to negotiate the purchase of
additional right-of-way on Lots 11 and 12 or would have to condemn that road right-of-way.
I raise these points because it is my understanding that the variance that was issued to Lot
10 was conditioned upon staff attempting to widen the road right-of-way that exists on Lots 11
and 12. It is my opinion that as things stand with the current approvals, there is no way to make
the property owner of Lot 10 pay for the costs associated with widening the road on Lots 11 and
12. It will be up to the City to incur the costs to widen the road on Lots 11 and 12.
Upon reviewing this correspondence, please feel free to contact me as to what the next
course of action should be. It is my understanding that the Fire Marshall has some very serious
concerns regarding access in this area.
Please call me at your earliest convenience to discuss this matter.
Very truly yours,
CAMPBELL KNUTSON
Professional Association
----
By:--- _.____._
Soren M.
