It is my understanding that a single <br /> home currently exists on Lots 11 and 12 and that Lot 10 is in the process of being <br /> rebuilt and has recently received all of the zoning approvals to go forward with that <br /> project. As Lot 10 was being reviewed by staff during the zoning application <br /> process, the Fire Marshall noted that the road serving this house should be widened. <br /> It is my understanding that in fact the road on Lot 10 was widened to a satisfactory <br /> width for the Fire Marshall. The issue that has now arisen is that the portion of the <br /> road on Lots 11 and 12 is approximately 12 feet in width. Understandably, the Fire <br /> Marshall pointed out that the fire code requires a street width of 20 feet and <br /> suggested that, as part of the project for Lot 10, the road covering Lots 11 and 12 <br /> should be widened. <br /> In reviewing the legal descriptions that have been provided to us regarding <br /> the width of the road on Lots 11 and 12, it appears that the road is currently as wide <br /> as it can get with the existing easements. I am seeking guidance from you at this <br /> point as to how you would like our office to proceed with this matter. I believe there <br /> are a number of issues that should be addressed before making this decision. <br /> 1. The recorded easements state that the road on Lots 11 and 12 is 12 <br /> feet wide. While some of the surveys indicate that there may be additional room to <br /> shift the road to the south,the City would not be able to do this without conducting <br /> further surveys to determine where the true location of the road was meant to be. <br /> - - 2.
