MINUTES OF THE <br />ORONO CITY COUNCIL/PLANNING COMMISSION <br />JOINT WORK SESSION <br />September 26, 2016 <br />5:00 o'clock p.m. <br />PRESENT: Mayor Lili Tod McMillan, Council Members Jim Cornick, Aaron Printup, Lizz Levang, and <br />Denny Walsh. Representing Staff were City Administrator Jessica Loftus, Community Development <br />Director Jeremy Barnhart, City Planner Melanie Curtis, Senior Planner Michael Gaffron, and City <br />Attorney Soren Mattick. The Planning Commissioners in attendance were Denise Leskinen, Jon <br />Schwingler, Loren Schoenzeit, John Thiesse, and Janice Berg (Alternate). <br />City Attorney Mattick reviewed with the Council and Commissioners the variance processes and <br />provided information to consider in reviewing a variance. He encouraged the group to <br />continually ask themselves, why the variance is needed, and can a person do this project without a <br />variance? <br />Mattick noted that the Council may impose conditions on a variance, but there must be a nexus <br />between the condition and the variance requested. <br />Mattick reminded the group that the burden to support the variance was on the applicant, and to <br />approve a variance, all criteria must be met, but to deny, only one of the criteria need not be met. <br />Mattick reviewed two recent variance cases, including the changes that occurred post -approval, <br />and how the regulations were applied to these projects. <br />Adjournment at 6:45 p.m. <br />ATTEST: <br />Diane Tiegs, City Clerk Lili Tod McMillan, Mayor <br />Page 1 of 1 <br />
