Council <br />Exhibit H <br />DECLARATION OF COVENANTS, <br />CONDITIONS, RESTRICTIONS AND EASEMENTS <br />This Declaration of Covenants, Conditions, Restrictions and Easements (this <br />"Declaration") is made this day of , 2016, but effective as provided below, by <br />Irwin L. Jacobs, as Trustee of the Third Amended and Restated Revocable Trust of Irwin L. <br />Jacobs dated November 22, 2006, as amended on September 24, 2007, July 10, 2008 and <br />October 23, 2009, and Alexandra Jacobs, as Trustee under the Alexandra Jacobs Revocable Trust <br />Agreement dated November 22, 2006, as amended on October 23, 2009 ("Developer"), and is <br />based on the following facts: <br />A. Developer is the fee owner of real property located in the City of Orono (the <br />"City"), County of Hennepin (the "County"), and State of Minnesota, legally described as Lot <br />Block 1, Tanager Estates (the "Property") <br />B. The Property is the result of a subdivision, pursuant to the plat of TANAGER <br />ESTATES (the "Plat"). <br />C. The City has imposed certain conditions to approving the Plat. <br />D. Developer wishes to impose upon and subject the Property to certain covenants, <br />conditions, restrictions and easements, for the benefit of the Property, the City, and all present <br />and future Owners of any part thereof, and in order to satisfy the conditions for the City's <br />approval of the Plat. <br />216542.DOC-5 10/5/2616 <br />Error!
