I just learned earlier this week that the Bollis sub -division is up for final <br />approval with the Council on Monday night. <br />The last information that we received from Mr. Bolls is that they were submitting a revised plat to the City <br />to be reviewed in June. The Association has not had any contact with Mr. Bollis since June 14th, 2106 <br />when we were informed that he was proceeding with a new 5 -lot plat. I am very surprised and frankly, <br />disappointed that we have had no direct communication on this matter. <br />I want to go on record that we do not have an executed maintenance agreement between the developer <br />(Bollis) and the Kintyre Two Association as required by the preliminary plat approval r:lag , ,1 #128, GFS ga <br />:0 "'IZt where it clearly states that there is a legal document required to show "evidence that an access <br />and maintenance agreement between Kintyre Two and Kintyre Preserve homeowners associations has <br />been executed and is in effect'. Please see page 10, section 2D in the first attachment. <br />Furthermore, per the 3500 Watertown Road File No. 05-3152, it is stated clearly on page 3, paragraph 6 <br />that "such document is intended to allow for the extension of the road to the property to the north at the <br />cost of the developer of said property, and allow the future owners of the property to the north access to <br />Watertown Road via the private road, at no cost save for sharing of maintenance of said private road". <br />Please see page 3, section 6 of the second attachment. <br />To be clear, we are not asking the City to negotiate a maintenance agreement on our behalf. However, <br />we do expect the City to abide by the order and conditions set forth in the preliminary plat resolution for <br />the Bollis development. <br />We understand that the developer is planning to build a home in the new development and we look <br />forward to welcoming him and his family to the neighborhood. That being said, we believe it is reasonable <br />to expect a direct conversation on this plan and to work together, as neighbors, on an agreement that is <br />mutually beneficial.
