The Planning Commission reviewed this application on May 17, 2010 and on a <br /> vote of 6 - 0 recommended: <br /> a. Approval of the setback variance, based on the following findings: <br /> i. The house was constructed prior to the enactment of zoning <br /> regulations. <br /> ii. The encroachment into the setback is minimal and will not have an <br /> adverse effect on the adj acent property. <br /> iii. The modified roofline will allow for installation of additional <br /> insulation to comply with current standards. <br /> iv. The variance will allow a larger roof modification project that will <br /> make the appearance of the house more compatible with those in <br /> the surrounding area. <br /> b. Approval of the hardcover variance,based on the following findings: <br /> i. When the attached garage was constructed in 2001 resulting <br /> hardcover in the 75 to 250 foot zone was thought to be 23.88 <br /> percent. Based on 2010 hardcover calculations the 2001 hardcover <br /> level was at least 25.13 percent. A more precise determination is <br /> not possible because the accuracy of the area of the driveway in the <br /> 2001 calculations cannot be determined. <br /> ii. The driveway generally corresponds to the driveway in the 2001 <br /> hardcover calculations. It includes space for parking, a turnaround, <br /> and six inches of driveway width that are beyond the minimum <br /> requirements but are justified by the 350 foot distance between <br /> North Shore Drive and the residence. <br /> iii. The existing deck and steps is being replaced by a sunroom and <br /> steps. Although the steps are larger than the existing steps the <br /> sunroom is smaller than the deck. The result is a slight decrease in <br /> hardcover. <br /> Page 2 of 5 <br />
