O � CITY of ORONO � .;� � ti �� G~' RESOLUTION OF THE�CITY COUNCIL `�k'ESI��4 NO. � 3 $ A RESOLUTION GRANTING VARIANCES TO THE ORONO, MINNESOTA, CITY CODE SECTIONS 78-330 AND 78-1288 FILE NO. 10-3459 WHEREAS, Barbara A. Halper, a single person, (hereinafter "Owner") is the owner of the property located at 3200 North Shore Drive within the City of Orono (hereinafter "City") and legally described as: The east 57.75 feet of that part of Government Lot 1, Section 8, Township 117, Range 23, Hennepin County, Minnesota, lying north of the Road (hereinafter "the Property"); and WHEREAS, Owner has made an application to the City for a variance to Orono Code Section 78-330 to allow modification of the roofline of the dormer on the street side of the house when part of the dormer is only 8.1 feet from the side property line and a 10 foot setback is required; and WHEREAS, Owner has made application to the City for a Variance to Orono Code Sectian 78-1288 to have hardcover in the 75 to 250 foot zone in excess of the allowed 25 percent to allow enlargement of the lakeside steps and retention of existing hardcover; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission held a public hearing on May 17, 2010, at which times all persons desiring to be heard concerning this application were given the opportunity to speak thereon. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDING5 1. This application was reviewed as Zoning File#10-3459. 2. The Property is located in the LR-1B zoning district, where 1.0 acre is the minimum lot area and 140 feet is the minimum lot width. The Property is approximately 0.68 acre in area, 68 feet in defined width and 57.75 feet in width measured perpendicular to the side property lines. It measures approximately 520 feet in depth.
