. LAKE MINNETONKA CONSERVATION DISTRICT <br /> RESOLUTION N0. 73 <br /> RESIDENTIAL TEMPORARY DOCK EXTENSIONS <br /> WITHOUT A PERMIT APPLICATION <br /> WHE1tEAS LMCD Code §2.01, Subd. 2 d) requires that during periods when the <br /> Lake level falls below 929.4 feet and when so declared by resolution <br /> of the Board, the Executive Director may issue permits for temporary <br /> dock extensions beyond the authorized dock use area subject to cer- <br /> tain limitations; and <br /> WHEREAS LMCD Resolution No. 53 of 4-1-87 declared a low water emergency con- <br /> dition for Lake Minnetonka existed, and that resolution has not been <br /> rescinded but is still in effect; and <br /> WHEREAS Because an extraordinarily high number of residential temporary dock <br /> extension permit applications had been received for the 1989 season, <br /> that the Board on 5-24-89 waived applications under certain guide- <br /> lines for docks at residential properties; and <br /> WHEREAS On 1-24-90 the Board renewed the waiver of residential appiications <br /> for temporary low water extensions for the 1990 season; and <br /> WHEREAS On 2-26-91 the level of Lake Minnetonka stood at elevation 926.65 <br /> feet, N.G.V.D. , 1929, as observed and reported by the Minnehaha <br /> Creek Watershed District, 2.75 feet below elevation 929.4 feet; and <br /> WHEREAS It is proposed that the application requirements for temporary dock <br /> extensions at residential properties be waived for the 1991 season, <br /> with guidelines publicized and/or advertised to enlist public re- <br /> sponse and cooperation; <br /> NOW, THEREFORE, BE IT RESOLVED THAT the LMCD Board of Directors waive appli- <br /> cations for permits for temporary dock extensions at residential docks under <br /> the following guidelines: <br /> 1. Residential docks may be extended beyond the authorized dock use area <br /> (that being the area basically bordering on the Lake which extends into <br /> the Lake a distance equal to the site Lake frontage measured at right <br /> angles to the side site lines, and not extending into the Lake a dis- <br /> tance greater than 100 feet measured on a line parallel to the side site <br /> lines as extended into the Lake) on the following conditions: <br /> a. Dock is extended only to the extent necessary to meet the normal <br /> navigable water depth of three feet. <br /> b. No additional boats may be docked than permitted prior to the exten- <br /> sion as authorized by the LMCD Code. <br /> c. The extension shall be permitted only during the season during which <br /> the low water emergency has been declared by LMCD Board resolution. <br /> (continued) <br />
