� ,Lake Minnetonka Conservation District <br /> Regular Board Meeting <br /> October 9,2002 Page 4 <br /> Although water depths may be a problem at the Wallace site, he stated that he would be reluctant to include <br /> this site in the Findings because the water depths have not been documented and a public hearing has not <br /> been conducted. <br /> LeFevere stated that it would difficult to include the Wallace property in the Findings because the Pacovsky <br /> adjustment did not adjust the Wallace side site line extensions and the neighbors in the immediate area were <br /> not notified through a public hearing notice that variance from Code was being considered at the Wallace <br /> site. <br /> Babcock stated that the Wallace property could always make an application for variance from Code in the <br /> future. <br /> Foster stated that he believed the Board could support a 130' long dock use variance at the Blomberg site, <br /> noting that Mr. Wallace could make an application for variance from Code for dock length. The Board might <br /> want to consider waiving fees for the Wallace variance application; however, he believed that the Board <br /> should focus on the four sites that are included in the Findings. <br /> Babcock stated that he concurred with Foster; however, he was concemed about waiving fees for a <br /> hypothetical variance application for Wallace. <br /> LeFever�stated that the Board might want to consider the following changes in the draft Findings: <br /> • In A2) in the Order, Babcock has recommended changing the word "boat"to"watercraft. Babcock <br /> has also added language at all four sites in the Order that would require°all docks and watercraft to <br /> be contained in the defined dock use areas". <br /> • In C4) in the Order, Babcock has recommended limiting the watercraft length at the Pacovsky site to <br /> 24'length overall, with equipment at its normal operating position. <br /> • At the Blomberg site in the Order, it might make sense to adjust the dock use area length from 100' <br /> as detailed in the draft Findings to 130'as recommended by staff. He recommended that it might <br /> make sense to maintain the side setbacks at the Blomberg site from both side site lines as outlined in <br /> the draft Findings. <br /> McMillan stated that it might be beneficial for future residents and Board members to add language to the <br /> Findings that state what variance are approved at each property. At the Wallace site, they should make <br /> applications for a separate dock length variance if they would like to extend their dock 130'from the 929.4' <br /> shoreline because they are not directly related to the variance applications included in the draft Findings like <br /> the Blomberg property is. <br /> Mr. Rich Anderson, owner of North Shore Marina,stated that he believed the 24' length restriction for the <br /> watercraft at the Pacovsky site might be too restrictive based on the current market. <br /> Seuntjens stated that he might be supportive of a 26'length restriction at the Pacovsky site rather than 24'. <br /> Babcock stated that other applicants have been restricted to a 24' length restriction by the Board because <br /> that was believed to be a reasonable boat size on Lake Minnetonka. He recommended a 24' length <br /> restriction for consistency purposes. <br /> MOTION: Gilman moved, Babcock seconded to approve the Findings of Fact and Order for the Pacovsky, <br />
