The proposed ice ramp has been denied a permit on two <br /> occasions by the IVfinnehaha Creek Watershed District. The Watershed District has also indicated <br /> that they will not consider issuing an experimental permit for the project. Therefore, the project is <br /> not consistent with a local program, and our permit cannot be issued. <br /> Excellent technical resources are available to you to assist in designing and implementing an <br /> alternative to the ice ramp for protecting your shoreline from ice. You are encouraged to contact the <br /> 11Tnnehaha Creek Watershed District(612)471-0590 and the Hennepin Conservation District <br /> (612) 544-8572. <br /> Minnesota Statutes, Chapter 103 G, requires that "In all permit applications, the applicant has the <br /> burden of proving that the proposed project is reasonable, practical, and will adequately protect <br /> public safety and promote the public welfare." In view of our observations, we cannot conclude that <br /> your proposal is indeed reasonable and will promote the public welfare; therefore, the proposal <br /> presented in the application is in all respects denied. <br /> 11Tinnesota Statutes, Sections 103G.251, Subdivision 2(c), and 103G.311, Subdivisions 5, 6 and 7, <br /> provide for an administrative hearing if you or, in some cases, certain local units of govemment are <br /> aggrieved by the action taken on this pernut application. Be advised that to take advantage of this <br /> review process you must file a hearing request and a required $500.00 bond within 30 days of receipt <br /> of this order or you lose the right to any further appeals. <br /> ffyou have questions regarding the action taken on your pennit, or the appeal process, please contact <br /> Area Hydrologist Ceil Strauss or Staff Hydrologist Joe Richter at 772-7910. <br /> Sincerely, <br /> c✓�� � <br /> Dale E.
