Johnson <br /> 3105 North Shore Drive <br /> Wayzata, Minnesota 55391 <br /> RE: Commissioner's Order, Permit Application#96-6030, Lake Minnetonka, Crystal Bay <br /> (27-133-21), Hennepin County <br /> Dear Mr. Johnson: <br /> The Department of Natwal Resources has reviewed your application for a permit to place an ice ramp <br /> with anchors along 50'of shoreline, extending 13'waterward of the ordinary high water level of Lake <br /> l�nnetonka, at 3105 North Shore Drive, Wayzata, l�finnesota(located in the SW 1/4 of Section 9, <br /> T 117N-R23 W, Hennepin County). <br /> It has been determined that your application as proposed must be denied. Minnesota Rules, Chapter <br /> 6115.0210, Subp. 1, A states that "It is the goal of the department to limit the occupation of <br /> protected waters by offshore navigational facilities, retaining walls, and other structures in order to <br /> preserve the natural character of protected waters and their shorelands." It is the opinion of the DNR <br /> Section of Fisheries,lV�innehaha Creek Watershed District, and Hennepin Conservation District that <br /> your ice ramp does not preserve the natural character of the shoreline. <br /> Mumesota Rules, Chapter 6115.0210, Subp. 1, C. also requires the Department of Natural Resources <br /> to"encourage the removal of existing structures which do not serve the public interest from the beds <br /> of protected waters at the earliest practicable date." The proposed ice ramp is intended to protect <br /> private property, and it would not serve the public interest. Allowing the ice ramp to be built would <br /> clearly be against the intent ofthis rule. <br /> Mmnesota Rules, Chapte,r 6115.0210, Subp. 5, A. states that when a permit is issued"the proposed <br /> project must represent the minimal impact solution to a specific need with respect to all other <br /> reasonable alternatives." The DNR Section of Fisheries, Minnehaha Creek Watershed District, and <br /> Hennepin Conservation District recommended that riprap be properly installed along your shoreline. <br /> It is the opinion of these agencies that riprap represents the minimal impact solution for protecting <br /> your shoreline. <br /> 11�nnesota Rules, Chapter 6115.0211, Subp. 5, C, requires that"Adequate engineering studies shall <br /> be performed of foundation conditions, tiebacks, internal drainage, construction materials, and <br /> protection against$anking" for structures that are placed in DNR Protected Waters.
