� . <br /> ' i�/� O ' V <br /> O O <br /> �b. - C ITY of ORO�TO <br /> � � <br /> '� RESOLUTION OF THE CITY COUNCIL <br /> ��9kESH��`�G NO. � � '�� � <br /> A RESOLUTION GRANTING VARIANCES <br /> TO MUNICIPAL ZONING CODE <br /> SECTION 10.56, SUBDIVISION 16 (C) (6); <br /> SECTION 10.22, SUBDIVISION 2; AND <br /> SECTION 10.56, SUBDIVISION 16 (L) (1); <br /> FILE NO. #2437 <br /> WHEREAS, Jeff Martineau (hereinafter "the applicant") is the owner of the <br /> property located at 2565 North Shore Drive within the City of Orono (hereinafter "the City") <br /> and legally described as follows: <br /> See Exhibit A (hereinafter "the property"); and <br /> WHEREAS, after due published and mailed notice in accordance with Minnesota <br /> Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission <br /> held a public hearing on November 16, 1998, at w•hich times all persons desiring to be heard <br /> concerning this application were given the opportunity to speak thereon; and <br /> WHEREAS, the applicant has applied to the City for variances to Municipal <br /> Zoning Code Section 10.56, Subdivision 16 (C) (6) to permit a roof line alteration to allow a <br /> hipped style roof to be changed to a gabled roof within the average lakeshore setback; and <br /> Section 10.22, Subdivision 2 and Section 10.56, Subdivision 16 (L) (1) to permit 2,439 sq. ft. <br /> (20.21%) hardcover in the 0-75' lakeshore setback where 2,775 sq. ft. (22.99%) exists and none <br /> is allowed. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File #2437. <br /> 2. The property is located in the LR-lA Zoning District, �i-here 2 acres or 87,120 <br /> sq. ft. is the minimum lot area. The property consists of 1.47 acres or 64,2�0 <br /> sq. ft. <br /> Page 1 of 5 <br />
