Orono - Claim No.: PC0031814) Hi Christine, On May 22, 2014, a contested probation violation hearing was held before judge Moore.The judge ruled that Mr. Henke violated the terms of his probation and amended Mr. Henke's sentence by revoking the Stay of Adjudication.The new sentence is: 90 days jail stayed for 1 year; no housing, maintenance or zoning code violation; allow city inspector onto the property for exterior inspection within one week from May 22, 2014, remedy violations identified in writing within two weeks of receipt of notice, and allow re-inspection of the property; pay a fine of$900 plus a surcharge with $800 of it stayed for one year; and have no same or similar violations. Lyle and Melanie attended the hearing, and we discussed these deadline. On June 4, 2014, Mr. Henke filed a notice to stay the proceedings pending his appeal and a motion for a jury trial.The hearing on the motions is on June 19, 2014. In the meantime, he has to comply with the sentencing order. I am not sure which court documents you are referring to. If you were thinking about the sentencing order,we do not usually receive it. However, if you think it will be helpful, we can order it. Regarding his letter to Melanie, I am guessing that the package he is referring to is the list of the items that he needs to fix following the city's inspection. While he may indeed have some issues with blurry vision, I am afraid that he is just employing his delay tactics,yet again. Unless the matter is stayed pending his appeal, or he moves for an extension due to medical issues and one is granted, he needs to comply with the sentencing order or we will file yet another probation violation.
