Each window was provided with a window sticker that described in detail <br /> how the window is to be installed. The Building Code requires windows to be properly flashed <br /> to protect the wall system from water intrusion. Each window manufacturer has had their <br /> product tested and approved for use. The manufacturer's installation instructions must be <br /> followed to assure the window performs as it did in its testing and to maintain the manufacturer's <br /> warranty. The same window sticker states the manufacturer will not be responsible for moisture <br /> problems caused by "failure to install our products properly." As code enforcement personnel, it <br /> is our duty to inspect the windows and enfarce the Building Code and the manufacturer's <br /> installation instructions. Unfortunately, the inspector did not see that the windows were not <br /> installed per the manufacturer's instructions. This, however, does not mean the installation is <br /> approved. International Building Code Section 109 states, "Approval as a result of an inspection <br /> shall not be construed to be an approval of a violation of the provisions of this code or of other <br /> ordinances of the jurisdiction." <br /> In summation, it is the City's position that the windows were not installed per the manufacturer's <br /> instructions and must be removed and reinstalled correctly. It is also the City's position that the <br /> contractar that installed them incorrectly is responsible for correct installation.
