shall be construed so as to modify any waiver by insurance companies of rights of - <br /> subrogation. <br /> If such owner fails to do the required remedial work,the Association may do it or " <br /> have it done and send a statement for all costs incurred including administrative <br /> charges. The amount shown on such statement shall be considered a common <br /> expense which has been assessed by the Association(i.e., an assessment) and, <br /> accordingly, all of the provisions in this Declaration and the Bylaws relating to <br /> assessments shall apply thereto including specifically,but not limited to, Section <br /> 7 and 8 of Article VI hereof and all of the Sections in Article VII hereof <br /> In doing the remedial work the unit owner shall perform his responsibilities in <br /> such a manner as not to unreasonably disturb other persons residing within the <br /> Condominium or any other unit in the Condominium. <br /> ARTICLE VI. <br /> Assessments, Charges,Liens for Assessments aad Taxes; <br /> Required Funds and Reserves <br /> 1. Obligations of Unit Owners to Pay Assessments. Each owner of a Residential Unit <br /> shall be liable for the portion of common expenses allocated and assessed to his <br /> Residential Unit. Each owner of a Residential Unit shall be liable for the portion of <br /> Pazking Area Expenses allocated and assessed to his Residential Unit(s). <br /> 2. Assessments for Common Expenses,Parking Area Expenses and Expenses <br /> Benefiting Less Than All Units.Assessments for common expenses and Parking Area <br /> Expenses shall be govemed by Section S 15B.3-115 of the Act.They shall be allocated <br /> among the Residential Unit Owners on the basis of the percentage of common expense <br /> liability set forth on Exhibit "A" attached hereto. In addition, the Board may assess <br /> certain common expenses against fewer than all of the units as follows: <br /> a. Maintenance,Repair or replacement of Limited Common Element. Any <br /> common expense associated with the maintenance,repair or replacement of a <br /> limited common elernent shall be assessed against the unit or in equal shares <br /> against the units to which the limited common element was assigned at the time <br /> the expense was incurred; or <br /> b. Common Expenses Benefiting Less Than All Units.The Board may assess any <br /> common expense for projects benefiting less than all of the units against the units <br /> benefited; or <br /> c. Costs and Attorney's Fees.The board may assess any costs and attorney's fees <br /> relating to the enforcement of the provisions of the CIC Documents, the collection <br /> of any delinquent assessments or the foreclosure of any Association lien against <br /> the unit of the owner who is in violation of the provisions of this Declaration or <br />
