waived by reason of any failure to enforce the same, irrespective of the number of - <br /> violations or breaches which may occw. <br /> ARTICLE V. " <br /> Management,Maintenance,Repairs, <br /> Alterations and Improvements <br /> 1. Common Elements. <br /> i. Association.The Association shall be responsible for the maintenance,repair, <br /> alteration, improvement and replacement of the common elements including <br /> limited common elements. Nothing herein shall be construed so as to preclude the <br /> Association from delegating to such persons of its choice such duties as may be <br /> imposed upon it by the terms of this Article. <br /> ii. Unit Owner. In addition to observing the covenants set forth in the previous <br /> Article hereof, each unit owner shall be responsible for promptly repairing any <br /> and all damage to or destruction of any unit(s) or any common elements caused <br /> by his failure promptly to perform necessary maintenance and repairs to such <br /> owner's unit or caused by his negligent acts or omissions, or those of any <br /> occupant of his unit, or those of any invitee, licensee,or guest of his within 30 <br /> days after such damage occurred or any extension of such 30 day period granted <br /> in writing by the Association or to bear the cost thereof to the extent not covered <br /> by insurance(if applicable). Nothing herein contained, however, shall be <br /> construed so as to modify any waiver by insurance companies of rights of <br /> subrogation. <br /> 2. Units <br /> i. Unit Owner. Each unit owner is responsible for the maintenance,repair, <br /> alteration and impravement of his Residential Unit. This responsibility includes <br /> all internal installations within the unit which serve exclusively just the unit such <br /> as appliances,heating, plumbing, electrical and air-conditioning fixtures or <br /> installations, and any portion of any other utility service facilities located within <br /> the boundaries of the unit and serving just the unit.The unit owner shall perform <br /> his responsibilities in such a manner as not to unreasonably disturb other persons <br /> residing within the Condominium or any other unit in the Condominium. <br /> 'The unit owner shall repair and replace, at his expense, to the extent that such <br /> expense is not covered by the proceeds of insurance carried by the Association, if <br /> applicable, any portion of another unit and/or the limited common elements <br /> appurtenant to it which has been damaged or destroyed by reason of his negligent <br /> act or omissions, or the acts or omissions of any occupant of his unit, or the acts <br /> or omissions of any invitee, licensee or guest of such unit owner or occupant <br /> within 30 days after such damage has occurred or any extension of such 30 day <br /> period granted in writing by the Association.
