� o� <br /> 0 0 <br /> CITY of ORONO <br /> ,� -. ..�-. � <br /> . ti <br /> ti <br /> RESOLUTION OF THE CITY COUNCIL <br /> ��`9k'ESI;04�G n,o. 5 5 0 2 <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants variances to Orono Municipal Zoning Code Sections 78-30� and 12-1288 to allow <br /> a lot area of.34 acre when t�vo acres is required; a lot width of 102 feet when 200 feet is <br /> required; a front setback of 43 feet when 50 is required; a rear setback of 30 feet when 50 <br /> is required; a 22 foot setback from the east properiy line when a 30 foot setback is <br /> required; a 21 foot setback from the west side propei-ty line when a 30 foot setback is <br /> required; and 35.3 percent hardcover in the 250 to 500 foot zone when the ma.ximum is <br /> 30 percent, subject to the following conditions: <br /> l. Council approval is based on the site plan and house plan submitted by the <br /> applicants and annotated by City staff, attached to this Resolution as Exhibits A <br /> and B:� Any amendments to the site plan or house plan which are not in <br /> confonnity with City codes will require further Plannin� Commission and City <br /> Council review. <br /> 2. Hardcover in the 7�-250 foot zone shall be limited to 1,287 s.f. or 19 percent per <br /> the proposed plan and hardcover allowance summary• as depicted on Exhibit �. <br /> Hardcover in the 254-500 foot zone shall be limited to 7,952 s.f. or 32.3 percent <br /> per the proposed plan and hardcover allowance summary as depicted on Exhibit <br /> C. Applicants are advised that any future requests to increase hardcover or <br /> change the nature of existing/approved hardcover shall require City approval, and <br /> increases in hardcover will not likely be approved without concunent reduction in <br /> existing hardcover. <br /> 3. As much as possible drainage fi•om the driveway shall be diverted to a rain garden <br /> or otherwise detained on the property. <br /> 4. Applicants shall remove any plastic or fabric liner material from the decorative <br /> landscape beds on the property to ensure their permeability as non-hardcover <br /> surfaces. <br /> 5. Required removals of structure and hardcover shall be completed before a <br /> buildina permit is issued. <br /> 6. Authorities granted by this resolution run ���ith the property not with the <br /> applicants, but are germissive onlv and must be exerci�ed b� obtainina a buildina <br /> Pa�e � of� <br />
