If the raof fails as a result of faulty <br /> workmanship within ten (1Q} years from the date on which the work performed under this <br /> Agreement is completed, the Contractor's exclusive liability under this Agreement or otherwise is <br /> limited to the repair or replacement, at the option of the Contractor, af that portion of the raof <br /> which failed as a result of the faulty workmanship shall be your only remedy in the event of a breach <br /> of this workmanship warranty. (n order to obtain the warranty caverage provided in this paragraph, <br /> you must inform the Contractor in writing that the roof has failed within sixty {60) days after yau <br /> have discovered or should have discovered failure of fihe roof. There are na implied warranties of <br /> merchantability or fitness for a particular purpase applicable to this transaction. All express ar <br /> implied warranties except thase provided in this agreement and availabie under Minn. Stat. Section <br /> 327 A.02 - are excluded from this transaction and shail not apply to the labor provided under this <br /> agreement. The Cantractar shall not be liab(e for special, incidental, indirect or other similar <br /> damages arising from breach of warranty. Under no circumstances will the Contractor be liable or <br /> responsible in any fashion far damages grawing out nf or owing to any kind in the performance of the <br /> work described in this Agreement. <br /> Terms of Pa�,rment: AIE charges are due and payable to the Contractor on or before the date af <br /> completion of this jab unless other terms are noted on the front of this farm. A service charge of <br /> : 1.5°lo per month shall be imposed on all past due accaunts. You, the buyer, agree to pay a!I costs and <br /> expenses, including collection charges and attorney's fees incurred by the Con#ractor in enforcing the <br /> terms of this Agreement. <br /> Miscellaneous: This Agreement shall be governed in al( respects by the laws af the State of <br /> Minnesota. The terms of this Agreement shall not be modified ar altered unless the parties agree in <br /> writing. The entire Agreement of the parties is cantained herein and there are no agreements, <br /> understandings, representations, ar warranties between the parties except as set forth in this <br /> Agreement. No waiver of any provcsion caf this Agreement shaEl be valid uniess it is in writing and <br /> signed by the parties against wha the waiver is sought to be enforced. Na valid waiver of any <br /> p�ovision of this Agreement shall be deemed a waiuer of any other provision of this Agreement. <br /> 1.Mome Exteriors is not responsible far cracks in sheet rock or plaster due to narmal reroafing operation. <br /> 2. Home Exteriors is not respansible for dust or debris in attic. <br /> 3.Home Exteriors is not responsible for ice darnminq,ice backup or condensation. <br /> 4.Home Exteriors is not responsible for cratks in driveway. <br />
