� REGULAR MEETING OF THE ORONO COUNCIL HELD APRIL 23, 1984. PAGE 3 <br /> #804 PAINTERS CREER <br /> 4680 BAYSIDE ROAD <br /> PRELIMINARY SUBDIVISION <br /> AND CONDITIONAL USE <br /> PERMIT FOR PRD Bruce Lange and Ron Bastyr represented the Painters <br /> Creek Development Corporation. The following <br /> _ members from the public were present for this <br /> application: Bonnie Cuff of 4660 Bayside Road; Mr. <br /> and Mrs . Peter Achey of 4720 Bayside Road; Marc <br /> Fritzler and Desyl Peterson of 4385 Chippewa Lane; <br /> Lucy Yogerst and David Dunn of 4740 Bayside Road. <br /> Zoning Administrator Mabusth reviewed with the <br /> Council that these lots are actually building pads or <br /> ways to convey ownership of a rural lot. Mabusth <br /> stated that the 5 acre per unit density is assured with <br /> the credit of Outlots A and B. Mabusth stated that <br /> Outlot Cissetasideforfuture development. Mabusth <br /> stated that the applicant is asking that the City <br /> credit the area of McCulley Road sold to the City at the <br /> time the road was planned. In the absence of survey <br /> information, the owners were not aware that in selling <br /> the one acre to the City, they would be giving up one <br /> residential unit. Mabusth stated that the developer <br /> is dedicating land to the Dunn property to make a legal <br /> subdivision. <br /> Mayor Butler read the section of the code dealing with <br /> the purpose of a PRD: "The plan is available to land <br /> subdividers subject to Council approval as an <br /> alternative to the standard minimum lot size <br /> subdivision of land. The purpose of this plan is to <br /> enhance the appearance of neighborhoods through <br /> preservation of natural open spaces, to counteract the <br /> effects of urban congestion and monotony, to provide <br /> cohesive structure to neighborhood design, to offer <br /> recreation opportunities close to home, and to aid in <br /> improving the welfare in general of City residents. " <br /> Mayor Butler stated that PRD' s apply to the land in <br /> question and not the intent of the developer. Butler <br /> stated that PRD' s are used to preserve natural <br /> amenities such as trees and slopes . Butler stated <br /> that this property definitely has steep slopes and <br /> trees. Butler stated that this is an appropriate use <br /> for a PRD. <br /> Ron Bastyr stated that Painters Creek Development <br /> Corporation is dedicating land to the Dunn property. <br /> Bastyr stated that is the reason they are asking for <br /> credit from McCulley Road so that they can have three <br /> buildable lots on Outlot C at some future point. <br /> Bastyr stated that Outlot C was 14 . 7 acres and with the <br /> dedication to the Dunn property it will be 14 . 4 acres. <br /> Bastyr stated that the developer would rather see the <br /> City address the issue of Outlot C now. <br />
