REGULAR MEETING OF THE ORONO COUNCIL, SEPTEMBER 12, 1983. PAGE 9 <br /> #773 RICHARD ZUCKMAN Councilmember Grabek moved to direct staff to draft a <br /> resolution with the applicant and owner to either <br /> allow the structures to stand until deemed <br /> uninhabitableor until the City and owner establishes <br /> a reasonable phasing out schedule and adding points B- <br /> E from the staff inemo. No second , motion failed . <br /> Acting Mayor Frahm suggested a time limit to be set on a <br /> phase out method . <br /> Acting Mayor Frahm moved , Councilmember Hammerel <br /> seconded , to approve a conditional use permit and to <br /> direct staff to draft a resolution of approval to <br /> include the following points : <br /> 1 . Case 1 - If the owner decides to eliminate 7 usable <br /> down to 3 habitable units that within 3 years the <br /> City will grant the applicant the three <br /> residential units for that piece of property . <br /> ?_. Case 2 - If anyone of the units burns or is judged <br /> structurally uninhabitable at that time the unit <br /> is razed . <br /> 3. Case 3 - If at the end of 12 years that property is <br /> brought up to code (decision has to be made within <br /> 3 year period) he gets additional 2 residential <br /> units . <br /> 4 . Limit storage of boats to three fishing boats on <br /> 1 and . <br /> 5. All building repairs should be reviewed by the <br /> Buiiding Department . <br /> 6. Parking of all cars must continue to be on the site <br /> and not on North Shore Drive . <br /> 7 . Appl icant should continue to seek and employ other <br /> methods of reducing excessive hardcover . <br /> Councilmember Grabek asked where Acting Mayor Frahm <br /> came up with the 12 years? Grabek asked for <br /> explaination of the 12 year period? <br /> Acting Mayor Frahm stated that 12 years is a re�:sonable <br /> amount of time that the applicant can get his <br /> . investment out and at the end of that 12 years the <br /> appl icant has two buildable lots that are worth some <br /> money. Frahm noted that with this phasing out method <br /> this will bring the property up to code. <br /> Councilmember Adams noted that the property owner is <br /> giving up something by agreeing that in 12 years the <br /> property will be in conformance but the applicant is <br /> also getting the option of having three buildable <br /> lots. <br />
