Raiche �ppeared at the Cour.cil n��eting �yer his letter dated ,7uly lb , 1981 , to request realignment of the tax par_cels consistent w.ith his Torrenv Title . H� st�.ted that the tax parcel discr�pancy had clouded his title . He refused to believe tha-� the City haci any claim on the parking Iot/alley. The Council stated that if Raiche could get agreements in writing from Union Oi� and/or Ulrich, that the City would assist the parties in corr�cting the tax c�escription� accordinqly. I3ut, the City w�ould continue to exert all legal effarts to preserve pub.lic ownership and effect clear title to the C.iti� alley. Raiche refused to deal ��rith tk�e City. Ne said h� cculd not provide a quit claim d�ecl to the alley portion because he "is not tl�e own�r - hr-� �zas sold ar.d closed and now has a worthless CD until he gets this cleared up" . He said the new owners were not interested in deeding anything to the Ci.ty, even if such a compromise might avoid litigation. Mayor Vari Nest statecl that the City has a recarded deed to the alley. We have ownership which we will press. We would prefer to work with you to resolve the matter in as ctuick and amicable way as possible . If you were to provide a quit cl.aim deed to the City for the alley, you could probably take a tax deductian for the value . If you do r.ot wish to wo.rk with us, we will have to get a court order_ to establish our rights. The Mayor asked Raiche to h�.ve his attorney respond in writing to the City Attorney ' s letters, Raiche then left saying al.l that he wanted to do was correct the tax statements, that he had warked on this for six months and was getting r.owhere . He was not interested in c]_earing up ownership of the alley, "that is the Ci�y ' s problem" , all he was concerned with was who was paying taxes on what.
