Minnesota Statute 462 . 357 Subd. 6 (1) <br /> specifically says that a City "may not permit as <br /> a variance any use that is not permitted under the <br /> ordinance for property in the zone where the affected <br /> person' s land is located" . See the attached exerpts <br /> from a Minnesota Supreme Court case upholding <br /> enforcement of an ordinance prohibiting expansion of <br /> a non-conforming use . <br /> Zoning 1974 RR-1B 2 acre rural residential <br /> Property Specs 75, 550 sq. ft. = 1. 73 acre <br /> Consists of three separate tax parcels <br /> Council Meeting - July 28 , 1980 <br /> Mr. Orton Wisegarver was present to discuss his <br /> application. <br /> Mayor Van Nest stated that the City has many concerns <br /> with the expansion of commercial uses in this area. <br /> The concerns are : <br /> 1. Public safety <br /> 2 . Parking requirements <br /> 3 . Lot size <br /> 4 . Side yard setbacks <br /> 5 . Sanitary standards <br /> Mayor Van Nest moved, Paurus seconded, to request staff <br /> to review legal non-conforming uses, incorporating <br /> staff review of all City concerns for the August 11, <br /> 198U Council meeting. Motion, Ayes (5) - Nays (0) . <br /> Alan Olson, City Planner, entered into the record SUBDIVISION <br /> the request for a subdivision of Stephen Ward, , 4695 North Shore DrivE <br /> 4695 North Shore Drive, dated July 22, 1980 , which #563 <br /> states: Stephen Ward <br /> Zoning District: LR-1B <br /> Subdivision: Originally proposed as a metes and <br /> bounds division - now to be reviewed as a plat. <br /> Mr. Ward, the applicant, proposes a plat of his <br /> neighbor 's (Steve Major) property. The division <br /> will create a smaller parcel to be combined with <br /> Ward' s substandard lot. The proposal will correct <br /> setback problems for the principal structure, <br /> located on the existing lot line , and the accessory <br /> structure, a corner located within the Major lot. <br /> The division will not create setback problems for the <br /> Major ' s property. (Continued) <br />
