We want to eliminate <br /> some rental units over the next five years. <br /> Mr. Seifert has paid four water and sewer units and <br /> they are all connected. <br /> , Mayor Van Nest: You are not bringing site into <br /> total conformance and eliminating other rental units? <br /> Mr. Pearson: Only hardcover regulations. <br /> Mayor Van Nest: This is a single family residence <br /> area. This is an illegal non-conforming use . If <br /> this existed before the present zoning code was <br /> initiated, you should have an illegal non-conforming <br /> use permit. <br /> Mr. Pearson: No, my client does not have an illegal <br /> non-conforming use permit. <br /> Mayor Van Nest: All of the rental units should be <br /> removed. Simply because the units existed before <br /> the present zoning code was adopted does not permit <br /> you to expand the uses and not eliminate these rental <br /> units. <br /> Mr. Pearson: My client does not agree with this. <br /> We ask that you restrict the use now and leave the <br /> property in a non-conforming use. <br /> Mayor Van Nest: You may not increase the bulk of <br /> the housing while remaining in an illegal non-conforming <br /> use status. Leaving four structures on one lot, while <br /> increasing �he size of another is not what I consider <br /> to be conforming and is not in the City ' s interest. <br /> Councilman Paurus: I would consider an arrangement <br /> where the lakeshore structure would be eliminated <br /> now and the other two on a contractural arrangement <br /> over 2-4 years. <br /> Mr. Pearson: No. I would not recommend that my <br /> client agree to that. My client wants to improve <br /> his property now. You do not have authority to <br /> demand we remove existing rental units. <br /> (Continued) <br />
