The revised dock plan submitted by Mr. Rivers REZONING <br /> :�.may be a "new" dock under LMCD regulations 1440 Shoreline Drive <br /> which could then only extend 100 ft. from (Continued) <br /> shore. The proposal assumes a 200 ft. dock <br /> use area. <br /> 5. The only comprehensive planning consideration <br /> seems to be fhe basic one of indicating any <br /> commercial area outside of the MUSA line. The <br /> current lack of sewer and other urban services <br /> thus affects the existing B-2 property as much <br /> as it does this proposal. <br /> 6. No matter which option is followed, a proper , <br /> subdivision of Parcel 2500 should be completed ' <br /> by the property owners, with application to and <br /> approval by the City, in order to clear up the <br /> tax records. <br /> The Marina Committee has reviewed the 1980 dock license <br /> including the revised dock layout, and has tabled <br /> the review pending a zoning decision. If the zoning <br /> is denied, the 1980 dock plan would have to revert <br /> to the 1978 layout. If the zoning is approved, a <br /> decision will have to be made on 100 ft. vs. 200 ft. <br /> dock use area and thereafter, the proposed plan <br /> compared to all LMCD setback and performance standards. <br /> Mayor Van Nest reviewed the Planning Commission minutes <br /> of October 18, 1976 , pages 6 & 7, which state: <br /> Mr. Rivers is considering reaching an agreement with <br /> Mr. McMahan to lease or purchase his property to <br /> the north of the Windward Marine . This would include <br /> the residence behind "Mac' s Pizz�" building. P4r. Rivers <br /> is requesting approval for an addition to this residence. <br /> Existing residence is approxi�ately 38 ' from the shore- <br /> line. Proposed adc�ition would extend 9 ' closer to <br /> the shoreline resulting in a 29 ' lakeshore setback <br /> from the present shoreline. The applicant also <br /> has plans to remove the bait shop and the concrete <br /> slab between boat works building and residence. <br /> It should be stipulated that this lot would then be <br /> used residentially until such time when the applicant <br /> would decide to use this property commercially, and <br /> would therefore, be required to remove the residence. <br /> Mr. Olson stated the septic system should be reviewed <br /> and approved by the City Engineer. After considerable <br /> discussion, Van Nest moved, Hake seconded, that a <br /> variance to the 75 ' setback be granted and variance <br /> to area and lot width for construction to addition <br /> and variance to side lot setback and non-conforming <br /> use be approved conditioned on the following: <br /> l. Mac' s Pizza building be removed prior to construction <br /> 2. That there be no commercial use made of subject <br /> lot or lots between County Road 15 and Tanager Lake <br /> (Continued) <br />
