No commercial docks be constructed on the main (Continued) <br /> lake side with the exception of existing <br /> service dock for existing bouys <br /> 5. The septic system between Mac' s Pizza building <br /> and this house be reviewed by staff and any <br /> required modifications be made per their <br /> direction <br /> 6. The building slab and concrete slabs between <br /> the house and marina building to the south be <br /> removed next spring. Hardcover to be removed <br /> no later than June 1, 1977. <br /> 7. Subject to the petitioner posting $2 , 000 bond <br /> to guarantee removal of hardcover by June l, 1977. <br /> Motion - Ayes (7) - Nays (0) . " <br /> Mayor Van Nest also reviewed the October 25 , 1976 <br /> Council Meeting minutes, Pages 7 & 8, which state: <br /> "Henry Muhich, Building & Zoning Administrator, <br /> stated that Mr. James Rivers , 1442 Shoreline <br /> Drive, (Windward Marina) is considering reaching <br /> an agreement with Mr. Mc�2ahan whereby he would <br /> lease or purchase Mr. McMahan' s property to the <br /> north of the Windward Marine. This would include <br /> the residence behind Mac' s Pizza building. <br /> The existent residence is now only 38' from the <br /> shoreline (Mr. River' � measurement) . However, <br /> the water level is extremely low this year. Mr. <br /> Rivers is requesting approval for an addition to <br /> the house (non-conforming residence in B-2 zone) . <br /> The proposed addition would be 414 sq, ft. in area <br /> and extend 9 ' closer to the shoreline. This would <br /> result in a 29 ' lakeshore setback from the present <br /> shoreline. I do not have the data as to where the <br /> shoreline would be if the water level were at a <br /> 929. 4 elevation. <br /> In order to compensate for this additional hardcover, <br /> Mr. Rivers has agreed to remove the existing hard- <br /> cover surface extending to the shoreline between <br /> the Windward Marine building and D4ac' s Pizza building. <br /> This concrete asphalt slab is approximately 2000 sq. ft. <br /> in area. Approximately 1, 200 sq. ft. of this slab <br /> is located within the 75 ' shoreline setback line. <br /> If approved, he would also remove the building that . <br /> previously was used as Mac' s Pizza and more recently <br /> as a bait shop. <br /> (Continued) <br />
