Cook <br /> stated that the base course looks pretty good with one bad <br /> spot on the grade where the paver broke down. <br /> McCalpine stated they did not finish any paving in the City <br /> of Long Lake and that they had a lot of projects which they <br /> did not complete in 1979. He admitted that the paving machine <br /> that was used on the Orono project was an old one, that "it <br /> was an old one that we used, it sits in the yard, it is used <br /> � for emergencies only. We will use the new one when we finish <br /> the road in the spring. " He stated, "T am amazed that the patch <br /> job that we did between the ring road and the county road at the <br /> intersection is still standing there. " <br /> Malkerson then summarized the meeting by noting that the contractor <br /> had agreed to provide us in writing the assurances �necessary con- <br /> cerning the maintenance, the change order, the scheduling of the <br /> project, and the city would submit a letter to the contractor and <br /> to the bonding company. Malkerson stated tha� once all of these <br /> things are completed, then the city may consider issuing a check <br /> for the most recent pay request, it having to be understood that <br /> the city in no way is waiving any of its rights to claim liquidated <br /> damages. <br /> Johnson and McCalpine left. Thereafter there followed a discussion <br /> concerning the acquisition of easements and the sharing of costs <br /> thereof with the county. It is our understanding that there will <br /> be a 50-50 split on easements which in this case would include <br /> the retaining wall. <br /> BDM:ssl-5 <br />
