Brooks is attempting to remedy an error made when he transferred a pcsrtion of a 40+ acre parcel to the ilature Conservanc��. A lot of 2. 3 acres was created without Citv review � or approval as required by State Statutes for all subdivisions. The lot does not meet the minimum lot width requirement of 200' , rec�uiring a 10' variance. �311 of the other zoning standards for the district have been r.let. rsr. IIrooks explains in his letter of April 18, 1979 , the ��olsfeld Lake Company gave the land first to the Ilature Conservancy who in turn gave it to the State of P�innesota. At this point in time, it is irnpossible to realign the mutual lot line. The septic inspector has approved the septic design. The County has approved direct access of CSAH 6. The applicant has referred to some arrangement with the DNR concerning access off the DNR entry road to the east of the lot. In either case both accesses �vould involve a permit from the Hennepin County Highway Department. The Planning Comriission recommends approval of the ��olsfeld Lake Company Addition subject to the following conditions: 1. Grant lot width variance of 10' - no setback variance will be granted for new construction. � 2. Approve mound system per septic inspector' s recommendation citing necessary design rlodification�. 3. Direct access off CSAH 6 has been approved by County. Applicant may arrange for access of DP7R entry road. The use of either access will involve a permit. 4. Payment of park dedication fee of $200. 00.
