Alan Olson, Citv Planner, entered into the C�r1DI'i'IONAL USE PERMI <br /> record the following letter to Psr. �111an nuello, 3220 Navarre Lane <br /> attornev for Richard Proudfit,concerninc� a #459 <br /> conditional use r�ermit for 3220 Plavarre Lane Richard Proudfit <br /> dated August 29 , 1979 , which states: <br /> "The Council was in receipt of vour August 27, 1979 <br /> letter including ?�r. Proudfit' s signed staternent. � <br /> ^he Council' s direction frorl the Jul�� 24 , 1979 <br /> r.ieeting was that *ir. Proudfit sign the nrenared <br /> covenants for filing in the chain of_ title of_ the <br /> property. Because Mr. Proudfit is onlv a contract <br /> for deed holder, the fee owner ([�atschke) is also <br /> rec�uired to sic�n the covenants. The Council, on <br /> advise of the City Attorney, found that �our <br /> substitution of August 27, 1979 is not accentable. <br /> Because the covenants provided were not signed and <br /> returned as directed, the Citv Council acted to <br /> table the matter until the Septeriber 11, 1979 <br /> r.►eeting, and directed staff to draft a resolution <br /> calling for immediate enforcement of the zoning <br /> code seeking immediate terr_iination of the non- <br /> conforming use as o_f September, 1979. <br /> This resolution is being drafted and will be <br /> forwarded for your review before that meeting. <br /> In the interim, if you should change vour r_Zind <br /> and have the oric7inal covenants signed, T suspect <br /> that the Council will honor their July 24, 1979 <br /> agreement to waive enforcement until next summer. <br /> If you have any c�uestions, I suggest you contact <br /> Bruce Plalkerson.
