Olson, Village Planner , <br /> Dear Mr. Olson: <br /> I am in receipt of your letter bf August 6, 1979 to which <br /> you have attached an agreement entitled "Declaration of <br /> Covenants , Conditions and Restrictions" . <br /> The agreerlent is well-written and lengthy, and the point of <br /> it appears to be clearly that the City of Orono does have <br /> ordinances that have been properly enacted and are for the <br /> purpose of promoting health, safety, order, convenience, <br /> prosperity and general welfare for the City of Orono. The <br /> agreement goes on to state that the City has the right to <br /> enforce said ordinance. <br /> P�ir. Proudfit has not and does not dispute either of the above , <br /> and acknowledges that M.S.A. Sections 462. 01 and 462. 02 have <br /> already created the authority to enact ordinances and to <br /> enforce them. (See copies of statutes attachec�) <br /> - The agreement is entitled "Covenants , Conditions and Restric- <br /> tions" and is in the form of covenants and restrictions that <br /> are norr,�ally placed upon property by developers to give them <br /> the protection they wish to exert over the property they <br /> are developing; however, in substance, it restates an <br /> ordinance that is already in effec�t. <br /> It is my understanding that: <br /> l. An ordinance may be passed under the specific powers <br /> of a municipality M. S.A. 412. 221 and also under Ai. S.A. 462. 01 , <br /> and that it may enforce said ordinances under M.S.A. 462. 02. <br /> It is ac}:nowledged that the City may enforce said ordinances <br /> under its statutory authority. . <br />
