As of today, we have not received a signed cony. For August 28, 1979 meetinc�, I recommend the following action: If the covenants are signed: a motion to deny the conditional use permit application as an illegal non-conforming use, instructinq staff to record the covenants and to enforce the terrlination of such use after Julv l, 1980. If the covenants are not signed: a motion instructing staff to draft a resolution, siinilar to the convenants, but calling for immediate enforcement to terriinate the illegal non-conforrling use. Council Aseeting - August 28, 1979 P�Zr. Olson informed the City Council that neither Mr. Proudfit nor rsr. Taatschke have signed the covenants; also that a letter was received from I4r, nuello, dated Auc�ust 20, 1979, �ahich included a signed statement . from P�r. Proudfit terminating his non-conforming use at 3220 ilavarre Lane as of July 15, 1980. Letter - August 20 , 1979 - Pages 6-8 r4a��or Van Nest moved, Hurr seconded, to direct sta.ff to retract the oric�inal agreement and draft a resolution to imnediately enforce the zoning code to terminate the non-conforming use as of Auc�ust 28, ?979, but that Council might reconsider if covenant is signed.
