The Council should review the subdivision request #414 in relation to the above items. �aith the record clear, I recor,u�end approval of the pre- ' liminary subdivision. 4. The Council should review and establish the record concerning allowable usage o� the service station. It is an existing conditional use on a substandard lot in the B-1 zone and if the rezoning is approved, it will be a legal non- conforming use. The conditional use pernit should be established by resolution to include the following: a) The lot size and structure statistics. b) The use history. c) The allowable use including definition of business and/or product sales, hours of operation, required parking, required landscaping and curb cuts, allowable structure changes and/or additions and other such reasonable conditions v�hich are applicable to this business at this location. d) Any special dispensation to allow occupancy of the premises prior to final plat approval but not necessarily prior to required property ir.lproverients (such as curb installation) . , I �vould expect the above items to be discussed with direction for staff review and resolution preparation for the next meeting.
