Steilen, Popham, Haik, SUBDIVISION Schnobrich, Kaufman & Doty Attorney, to Mr. Jurgen 565 Leaf Street 3tielow dated June 12, 1978, states: (Continued) I have been informed by your attorney Thomas G. Barry, Jr. that certain clouds on title exist with regard to the real estate proposed to be platted as Stielow' s Addition. Mr. Barry is aware that the City of Orono requires that title problems be cleared prior to final acceptance of the plat so that the City may be assured that all owners have executed the plat and that all public easements and public right-of-way have been properly dedicated. PZr. Barry has requested that the City waive this requirement in this particular instance because terms of your interest in the real estate require that you obtain final plat approval by a certain date and there is insufficient time to quiet title prior to that date. Pzr_ Barry assures us that the title problems, even if not successfully cured, could not affect the public easements proposed in . Stielow's Addition. Therefore, we are willing to recommend to the City Planner that the City waive the requirement that you clear title prior to acceptance of the final plat. Such waiver is based on the following :onditions: 1. Sween and Salazar, Ltd. , shall execute a title opinion to th:e entire real estate to be platted as Stielow' s Addition which opinion shall state � that title is clear other than for the two exceptions discussed in previous correspondence ' with our office and which shall further state an opinion that in the event that you are � - unable to cure title, none of the public easements, public r.ight-of-way pr private right-of-way established by the plat shall be affected. 2. We wish to have an indemnification agreement in a form acceptable to the City executed by you and your spouse as individuals .as jaell as by the proper corporate officers, which indemnification would indemnify and hold harmless the City of Orono against any claim, damage or lass whiah might be brought by any future owner of the real estate to be platted or any other person or entity because of the. City failing to xequire perfection of title prior to approval of the plat. 3. We wish to have a written undertaking by you and your attorneys indicating that you will undertake to cure title within a specific period of time. _ We will accept any reasonable time in that agree- ment.
