Steilen, Popham, Haik, SUBDIVISION <br /> Schnobrich, Kaufman & Doty Attorney, to Mr. Jurgen 565 Leaf Street <br /> 3tielow dated June 12, 1978, states: (Continued) <br /> I have been informed by your attorney Thomas G. <br /> Barry, Jr. that certain clouds on title exist with <br /> regard to the real estate proposed to be platted <br /> as Stielow' s Addition. Mr. Barry is aware that <br /> the City of Orono requires that title problems be <br /> cleared prior to final acceptance of the plat so <br /> that the City may be assured that all owners <br /> have executed the plat and that all public easements <br /> and public right-of-way have been properly dedicated. <br /> PZr. Barry has requested that the City waive this <br /> requirement in this particular instance because <br /> terms of your interest in the real estate require <br /> that you obtain final plat approval by a certain <br /> date and there is insufficient time to quiet title <br /> prior to that date. Pzr_ Barry assures us that the <br /> title problems, even if not successfully cured, <br /> could not affect the public easements proposed in . <br /> Stielow's Addition. <br /> Therefore, we are willing to recommend to the City <br /> Planner that the City waive the requirement that <br /> you clear title prior to acceptance of the final <br /> plat. Such waiver is based on the following <br /> :onditions: <br /> 1. Sween and Salazar, Ltd. , shall execute a title <br /> opinion to th:e entire real estate to be platted <br /> as Stielow' s Addition which opinion shall state <br /> � that title is clear other than for the two <br /> exceptions discussed in previous correspondence ' <br /> with our office and which shall further state <br /> an opinion that in the event that you are � - <br /> unable to cure title, none of the public easements, <br /> public r.ight-of-way pr private right-of-way <br /> established by the plat shall be affected. <br /> 2. We wish to have an indemnification agreement in <br /> a form acceptable to the City executed by you <br /> and your spouse as individuals .as jaell as by <br /> the proper corporate officers, which indemnification <br /> would indemnify and hold harmless the City of Orono <br /> against any claim, damage or lass whiah might be <br /> brought by any future owner of the real estate <br /> to be platted or any other person or entity <br /> because of the. City failing to xequire perfection <br /> of title prior to approval of the plat. <br /> 3. We wish to have a written undertaking by you and <br /> your attorneys indicating that you will undertake <br /> to cure title within a specific period of time. <br /> _ We will accept any reasonable time in that agree- <br /> ment. <br /> End of letter (Continued) <br />
