REGULAR P�EETING OF THE ORONO COUNCIL, P7ARCH 30, 1978 Page 8 Mr. Alan Olson, City Planner, entered into the re- SUBDIVISION cord the following information concerning the request 3024 Casco Point Road for a subdivision of Joseph Braun, 3024 Casco Point #002 Road, dated February 23, 1978, which states : Joseph Braun The applicant, Joseph Braun, and purchaser, Steve Plowman, were present, each represented by an attorney. Alan Olson read over chronology of events over the three years since the subdivision was first presented. Important points noted and acknowledged by the attorneys present were that the delays on this application were caused by the applicant' s failure to proceed and not by any action or lack of action by the City. On the contrary, the minutes of each City action clearly indicate the necessary steps for division completion and indeed, the applicants acknowledge that they still cannot agree among themselves over details of whom should proceed with the application. The Council reviewed the entire chain of events and took particular note of the Planning Cor.unission recor.u�endation made February 6 , 1978. The Council instructed staff to prepare a resolution setting forth findings of fact as to why the division should now be denied. Council D4eeting - March 30, 1978 Mayor Van Nest asked the applicant if all parties concerned had time to review the resolution drafted by staff to deny this plat. Mr. Bruce Malkerson, City Attorney, comr►ented that he had forwarded copies of this resolution to the applicants' attorneys. Mayor Van Nest moved, P4assengale seconded, to table the resolution to deny the plat of .7oseph Braun, 3024 Casco Point Road, until the next rleeting to allow the applicants to respond in writing to this proposed resolution. Psotion, Ayes (3) - Nays (0) . The applicant was not present concerning the [-�ayzata �aAYZATA COUNTRY CLUB Country Club proposal. This iter.► was deferr_ed until later in the evening.
