(Continued) <br /> The Planning Commission addressed the issues of <br /> access and clear title to the �roperty relative <br /> to the State letters dated NoveMber 30 , 1977 and <br /> January 17, 1978 . <br /> The proposed plat as subr:litted indicates south <br /> lot line of proposed Lot l, Block 1 extending to <br /> current right-of-way of Highway #12 . State letter <br /> dated January 17, 1978 indicates differently. <br /> Mr. ti�lear expressed concern over vacating of old <br /> ric�ht-of-way which State has never abandoned. <br /> The Planning Cor.unission also expressed some <br /> conc��n about the access to Lot l, Block 1 over <br /> the unabandoned right-of-way. • <br /> The developer assured the Commission that the <br /> State would aba-�don subject right-of-way and, <br /> through vacation procedures by the City,he could <br /> acquire title to the property. The Zoning <br /> Administrator suggested tabling the matter until <br /> proper title can be shown and all conditions for <br /> final resolution of plat approval are met. <br /> Mr. �Jear stated he would object to vacating of <br /> ric�ht-of-way because of the Potential obstruction <br /> of his establishment next door. <br /> After further discussion, Pla nning Commission <br /> recorunended approval of preliminary plat because <br /> the controversial parcel, Lot l, Block l, would <br /> meet zoning area and width requirements even <br /> though the State land was not acquired. Approval <br /> was given subject to the following additional <br /> conditions: <br /> 1. City Engineer' s approval of all utility and <br /> drainage easements. • <br /> 2. State approval of access approach. <br /> 3. Resolving� availability of municipal sanitary <br /> sewer connection to Long Lake se�aer line <br /> (approval of Long Lake Council and City <br /> Engineer) <br /> 4 . City Attorney' s a�proval of current title <br /> opinion addressed to the City. <br /> 5. No park dedication fee rec�uired. <br /> The Planning Commission also reaffirmed reco�ending <br /> previous approval of revising B-1 zoning line by <br /> moving zoning district line 60 ' to the north of <br /> current zoning line (action at meeting of October 3, <br /> 1977) . <br /> (Continued) <br />
