RE�UL�R MEETING OF TH� ORONO COUNCIL, JArIUARY 9, 1978 Page 2 <br /> r . <br /> WIiEREAS, the City Council of the City of Orono RESOLUTION #862 <br /> has adopted floodplain and con.servation regulations 2515 Kelly Avenue <br /> for the protection and preservation o�� the lakes , (Continued) <br /> wetlands ,shoreline ,and conservation areas of the <br /> City consistent with the adopted Storm ��Jater <br /> r2anagement Plan; and <br /> WIiEREAS, the Planning Commission and City Council <br /> have reviewed the variance request of Harry <br /> Gustafson to allow for the expansion in bulk of <br /> an existing boat house located on his property <br /> at 2515 Y.elly Avenue. <br /> NOL9, THEREFORE, BE IT RESOLVED, that based upon <br /> all of the information presented by the applicant <br /> and the reports of the City staff and Planning <br /> Comr,iission, the City Council hereby denys the <br /> variance request for the following reasons: <br /> 1. The existing building is entirely within the <br /> lakeshore conservation and floodplain area. <br /> 2. The nroposal would be a major addition of an <br /> entirely new story above the existing structure. <br /> 3. The proposal would intensify the use of the <br /> non-conforming structure_ <br /> 4. The proposal would increase the bulk of the <br /> non-conforming structure. <br /> 5. The proposal would tend to prolong the <br /> existence of the non-conforming structure. <br /> 6. The proposal would tend to be a visual <br /> obstruction within the lakeshore conservation <br /> area rising above the adjacent lawn level <br /> where the existing structure is flush with <br /> the adjacent lawn level. <br /> Butler moved, Psassengale seconded, to adopt <br /> Resolution #862, A Resolution Denying The <br /> Variance Request Of Harr_�� Gustafson, 2515 Kelly <br /> Avenue.
