, RI:GULAR r4EETING OF THE ORONO COUNCIL, JAr1UARY 9 , 1978 Page 17 <br /> Paurus r.ioved, Pesek seconded, to adopt Resolution ' RESOLUTION #863 <br /> #863, A Resolution Declaring Certain Liquor Store NSF Checks <br /> Checks Uncollectible, Removing Same From Lic�uor <br /> Accounts, And Referring Them To The City Attorney <br /> For Appropriate Actions. A�otion, Ayes (5) - Nays (0) . <br /> Dick Benson, City Administrator, informed the 1978 LEVY BASE APPEAL <br /> City Council that on August 8, 1977, the City <br /> passed Resolution #817 which increased the levy <br /> limit base for 1977-78 by ten percent. Betc•�een <br /> this time and the scheduled public hearing <br /> regarding the increase, we determined that the <br /> wrong figure was used for the adjusted levy <br /> limit base. At the public hearing on Septermber 7, <br /> 1977, this fact was noted and Resolution #819 was <br /> passed, which amended Resolution #817 in order <br /> to reflect the correct adjusted levy lir.iit base. <br /> On December 5, 1977, we received a letter from <br /> the State of Minnesota, Departr.ient of Revenue, <br /> Local Government Aids and Analysis Division, <br /> stating that the laws governing the ten percent <br /> levy limit increase did not provide for increasing <br /> the original resolution and, th.erefore_, the City' s <br /> levy limit base was to be reduced back to the <br /> original amount stated in Resolution �817. <br /> On December 16, 1977, the City sent a letter to <br /> the Commissioner of Revenue to request a hearing <br /> before the Levy Limitation Review Board in order <br /> to appeal this decision. <br /> On December 30, 1977, the City received a reply <br /> from the State of rsinnesota, Department of <br /> Revenue, Local Government Aid and Analysis <br /> Division, stating that their position on this <br /> was being reviewed and we would be notified of <br /> the decision. <br /> To date the foregoing is all the information <br /> I have. <br /> Mayor Van Nest moved, Pesek seconded, to approve <br /> appealing the State of Minnesota Department of <br /> Revenue' s decision if necessary. Motion, Ayes (5) - <br /> Nays (0) . <br />
