(Continued) <br /> nd I would think that the Council should act on <br /> my client' s request this evening. <br /> S Councilmember Massengale: The issues are complex. <br /> We do not want to rehash what is already in the <br /> record. My questions are: <br /> l. Is lot buildable? <br /> 2. Do present easements affect buildability of <br /> lot? <br /> 3. How do we address ourselves to easements and <br /> distinguish between easement and lot buildability? <br /> This lot could be huildable but we do not have <br /> complete data and other information to allow us <br /> to fully understand the status of the lake ease- <br /> ment. <br /> Mr. Henry Muhich presented a memo from Mr, r7ike <br /> Scheller, the previous building inspector, dated <br /> October 10, 1974 , which states: <br /> "Fred Rogers, through a trade of property for a <br /> residence he owned, has acquired two lots he <br /> � -•ishes to establish as building sites. I will <br /> ake each separately. <br /> Tract G, RLS 269 has 0 . 49 acre of the required one <br /> acre. The area will be sewered in the near future <br /> ! and is the last of seven lots in this subdivision <br /> all substantially the same size. These lots are <br /> serviced by a private easement. <br /> � Parcel 1210, Sec. 9 is 100 ' by approximately 240 ' <br /> or 24, 000 ' of the required one acre. This will <br /> 'a be serviced with the same sewer project in the <br /> near future and is also serviced by the same <br /> private easement. There is an old residence on <br /> it that would have to be razed. I would recommend <br /> approval on thesE two lots. " <br /> Mr. Muhich continued by stating that this lot <br /> ' meets 67% of required lot size, including <br /> easements. <br /> , Mr. Jack Rhode commented that there is a $15 , 000 <br /> sewer assessment on the property. On December 23, <br /> 1976 , this property was deeded to him. <br /> I✓r. Jerry Rice, representing Mr. Becker, commented <br /> �at both Mr. Rogers and Mr. Rhode had equitable <br /> interest at the same time on this lot. <br /> (Continued) <br />
