i <br /> � ORONO� COUNCIL MEETING HELD FEBRUARY 14 , 1977 Page 29 <br /> � Henry Muhich, Building & Zoning Administrator, VARIANCE <br /> stated that Gary Petersen, 3545 Ivy Place, has 3545 Ivy Place <br /> � made application for a variance on Lots 184 and #219 <br /> SW. 45 ' of Lot 185 , Taylor' s Subdivision of Gary Petersen <br /> � Spring Park. <br /> � Mr. Dave Newman, attorney, represented r4r. Petersen. <br /> � He presented a report by his associate, Douglas <br /> Klint, regarding applicant' s position regarding <br /> � variance proposal (copy enclosed) . <br /> � The Zoning Administrator explained request as <br /> M submitted which included four variances. Also <br /> noted that applicant had indicated he would move <br /> � the proposed house location if necessary to meet <br /> the lakeshore setback requirement. More engineering <br /> � data and surveys would be necessary to confirm <br /> this, however. , <br /> � <br /> : Tract V, a vacant parcel, directly northwest of <br /> the subject lot is currently owned by the State <br /> � of P�innesota due to tax forfeiturP. Any proposed <br /> structure on Tract V would not meet setback require- <br /> � ments. A combination of these two parcels would <br /> eliminate the current problem of two adjoining <br /> � substandard lots. <br /> • The Planning Commission recor,unended denial of the <br /> . variances because the travelled road currently <br /> located witYiin the lot lines of Lot 184 deducts <br /> � from the total buildable area of this lot and <br /> additional land is available. <br /> • <br /> � Council Meeting - February 14, 1977. <br /> s Mr. Dave Newman, attorney representing rir. Dave <br /> Petersen, read into the record the following <br /> � Statement of Facts: <br /> � Mr. P. Gary Petersen has purchased the above <br /> � described property from the Estate of Arthur P. <br /> Bendel with the intention of building a house and <br /> � living on the property. The property was platted <br /> in 1885 as Lot 184 of Taylor' s Subdivision of <br /> � Spring Park Lots and was in cor;lpliance with all <br /> zoning and platting laws at the time it was platted. <br /> � The Village of Orono subsequently accepted and <br /> � approved the plat. <br /> � Of the 13 lots in this subdivision, Mr. Petersen' s <br /> property is the largest. The other 12 lots range <br /> � in size from 10,400 sq. ft. to 12 , 500 sq. ft. P-ir. <br /> Petersen' s property is 14,271 sq, ft. in area.
