Motion, Ayes (4) - Nays (0) . <br /> � <br /> , Dick Benson, City Administrator, read into the COr4PREHENSIVE SEWER PLAN <br /> record the following letter received from the <br /> � Metropolitan Council, dated May 19, 1977 : <br /> � On P�4ay 18, 1977, the Metropolitan Council <br /> � received the Comprehensive Sewer Plan from the <br /> City of Orono for its comments and recom- <br /> � mendations. <br /> � If there are questions or if further information <br /> • is needed, the Council will contact your office. <br /> End of letter <br /> � Mr. Bruce Malkerson, City Attorney, discussed STEWART PERRY MATTER <br /> with tlie City Council his letter to Mr. Stewart <br /> �Perry, dated i�Iay 17, 1977, which states: <br /> � I have reviewed your writ of certiorari with the City Council <br /> r of the City of Orono to determine whether or not the city is <br /> interested in any way in discussing settlement of this matter. <br /> � <br /> • As you may recall, after you were tagged for having violated <br /> the Zoning Code, the suggestion was made that as part of the <br /> � possible settlement review, that you apply for the necessary <br /> permits for excavating, grading, filling and placement of <br /> ' structures within 75 f eet of the shoreline of Lake Minnetonka. <br /> During that settlement review process, the City of Orono bffered <br /> � to settle the lawsuit with you on February 28, 1977, as follows: <br /> � "Mayor Van Nest stated that in order to do a complete <br /> � job, the lower ties and decking should be removed and <br /> • standard riprap should be installed to the Minnehaha <br /> � Creek Watershed District standards. There is no <br /> question that a mortared wall will not withstand wave � <br /> � action and ice pressure in the spring breakup and <br /> will deteriorate, rir.
