, REGUL,AR MEETING OF THE ORONO COUNCIL, MAY 23, 1977 Page 14
This is in the RR-lA zone - five acre minimum SUBDIVISION
area. One lot contains a house. We can use the 3700 Bayside Road
simpler procedure on this if we accept the (Continued)
irregular lot lines and the variance from the 300
ft. lot width requirement at the location of the
s existing dwelling. The existing dwelling location
does not meet setback requirements.
I have sent copies of the proposal to the County,
the City Staff including the Administrator,
Attorney, Engineer, Finance Director, and Public
Works Department for review, reports and recom-
i mendations to include in the proposal if necessary.
A park dedication fee of $500 would be fortcoming
upon final approval ($250/lot) . A public hearing
will be scheduled for Pday 16 , 1977 at 7: 30 P.M.
* Planning Commission Meeting - May 16 , 1977
Comments heard from applicant and neighbor,
Hazel Anderson. Concerned with continuation of
existing access easement for Mrs. Anderson
across south edge of Burger' s proposed west lot.
Concerned with proposed easement through east lot
so west lot has access between portions split by
wetlands. Mr.Burger stated that irregular lot
configuration is due to having designed and
located his proposed dwelling prior to deciding
where the lot would be split. Mr. Burger also
stated that he would like to use one or more of
his existing lots on and under Stubbs Bay for
lake access and dockage for the proposed lot.
He says that he now has one dock here for the
existing house.
Recommended approval of the proposed division
(preliminary) because each parcel would meet
the five acre dry buildable minimum zoning
requirement and that the variances for the
existing house location and east lot width are
justified by the existing lot contours and
improvement locations, subject to payment of a
park dedication fee. The Council should address
' the riparian right to these lots.
Council Ieeting - May 23, 1977
Mayor Van Nest moved, Paurus seconded, to approve
the preliminary subdivision request of John Burger,
3700 Bayside Road, subject to:
l. Two acre zone line moved to east border line.
 2. Conservation easement south edge of west lot.
3. Easement to lots to the west.
4. Proposed lot not considered riparian to the lake.
5. Park dedication fee being paid.
6. Title opinion to the City.
Motion, Ayes (4) - Nays (0) .
