Corporation, asked why a denial was <br /> shown on the Council agenda. <br /> • <br /> Mayor Van Nest corrected the record by stating <br /> � that the denial was recommended by the Planning <br /> . Commission. <br /> ,r tdr. Phleger continued by stating that the owner <br /> was led to believe that the lot in question was <br /> � buildable by the fact that it was assessed and <br /> that at the date of the new code (December, 1974) , <br /> • the property was in single ownership. Mr. Phleger <br /> • presented a contract for deed dated November 1969 , <br /> showing that the lot was in single separate owner- <br /> � ship. <br /> � Mr. Phleger was informed that in 1967, the City <br /> determination that any substandard lot not in <br /> � single separate ownership would be declared as - <br /> unbuildable. Standard procedures have been <br /> � that when sewer or water is assessed, it is on <br /> � an area front footage and unit or connection <br /> charge to be paid when permit is applied for. <br /> � In this particular- �ase, an error was made and <br /> a water unit charge was assessed to the lot in <br />� question�. <br /> • Mayor Van Nest moved, Welsh seconded, to direct - <br /> + staff to prepare a resolution to deny based upon <br /> applicant not documenting hardship, improper <br /> � width and square footage (size) . Tract E owned <br /> by D. J. Corporation, purchased in 1968 in common <br /> + ownership and sold in 1969, as per Planning <br /> Commission minutes and abating the water unit <br /> � charge because of engineering error.
