The last action by Council was June 14, <br /> 1976, when Mr. Perry was advised that the <br /> r retaining wall portion of the work was reluctantly <br /> approved, but that the seawall must be removed. <br /> � The enclosed correspondence followed, and then <br /> � Mr. Perry was tagged for non-compliance to <br /> 31. 700 on SeptPmber 8, 1976. The matter was <br /> � before the Municipal Court on January 18, 1977 <br /> for a pre-trial hearing at which time P'Ir. Perry <br /> � suqgested a compromise. Briefly, in Iieu of <br /> removal of the treated wood seawall, P�Ir. Perry <br /> � says he will cover the wall with a new mortared <br /> � stone facing to prevent water from reaching the <br /> wood and to change the appearance of the wall. <br /> � The question before the Council is whether <br /> or not this suggestion will be satisfactory, <br /> � and to what extent the facing should be done <br /> (only part way up or completely covering the <br /> � seawall) . The matter is on the Court calendar <br /> for Psarch 15, 1977 for trial or continuance <br /> � depending upon the Council decision. <br /> �� Planning Commission Meeting - February 7, 1977 <br /> Planning Commission examined hotos and sam le <br /> P P <br /> � of stone he provided. Commission discussed <br /> situation and considered Mr. Perry' s suggested <br /> � addition of a mortared stone facing covering <br /> • the bottom two ties of the seawall. Planning <br /> Commission recomr.iended (agreeable to Mr. Perry) <br /> � approval to remedy an existing situation only; � <br /> they said that they would not have approved it � <br /> � if originally presentd this way.
