A. T. Esco, appeared 300 Crestview Avenue <br /> � at the public hearing and re quested that the <br /> Commission review the survey prepared for the <br /> � Escos, It showed the garage and a portion of <br /> the existing house, including the well, pro- <br /> '� truding into Hill Streets The attorney stated <br /> � that the only way the Escos could obtain <br /> mar}cetable title for their property was by <br /> � vacation of that portion of the street where <br /> the house is located. It was noted that Lots 7 <br /> � and 18, the easterly properties, had not yet <br /> been developed and so access problems still <br /> � existed for these tractse Van Nest noted that <br /> , tremendous ravines existed on these lands <br /> making it impractical to build an access <br /> � except through Hill Streete Mr. Snyder <br /> explained that the Escos had retreated in their <br /> � request for a complete vacation but were only <br /> asking for 3. 8 ft. so that the house will be <br /> � completely on Esco owned property. He explained <br /> that this was an existing situation when the <br /> � Escos purchased the property and they were <br /> . presently in a law suit for the former owner <br /> concerning ti�e issue. <br /> � After the public hearing, the Comr.iission proceeded <br /> � to discuss the problem. McDonald felt that no <br /> road would ever be constructed but was a possible <br /> � future need for its existencee Pesek felt that <br /> 30 � ft. would not be harmful and the balance <br /> � could still service the lands to the east. The <br /> ' Zoning Administrator disagreed stating that the <br /> City would need the full road for future utilities <br /> � and maintenancee Van Nest noted that in order <br /> to vacate land a public interest must be servedo <br /> r The members, in turn, felt that the Escos were <br /> public and the situation created a hardship to <br /> • theme It was agreed tha� the City Attorney be <br /> � consulted as to what constitutes public interest <br /> and the City Street 5uperintendent was to what <br /> � maintenance problems might result from the vacation, <br /> � The Commission tabled the application until they <br /> had receipt of recommendations from the City <br /> • Attorney and Street Department, <br /> r Planning Commission P�eeting - April 19 , 1976 <br /> � The Planning Commission recommended to the Council <br /> • that the City vacate a four foot strip of Hill <br /> Street lying adjacent to the entire extension <br /> � �f the Ae Te Esco property because it would be <br /> unrealistic to believe that Hill Street could <br /> � serve as access to any other property except <br /> Lot 7 and the remaining 36 fte of the street <br /> � would provide ample access to Lot 7 and the <br /> Commission stror.�ly advises that no consideration (Continued) <br /> • <br />
